Personal Declaration & Waiver for Kod Blue: Laut Needs You 2025

I acknowledge that I am registering to participate in Reef Check Malaysia’s (RCM) event, Kod Blue: Laut Needs You 2025, held on 20 September 2025 at Kampung Juara, Tioman Island. I understand I am responsible for arranging my own transport, accommodation, and meals, and will be assigned to a beach or underwater cleanup by the RCM team on the day.

I agree to inform RCM if I’m unable to attend. I understand that the participation fee is non-refundable.

Waiver of Liability & Assumption of Risk
I understand and accept that participating in this event involves risks, including but not limited to:

  • Minor injuries (cuts, bruises, sprains),

  • Serious injuries (fractures, joint injuries, concussion),

  • Injuries related to swimming/diving,

  • Severe injury or death.

I agree to follow all safety instructions provided by RCM. I accept all risks of injury, death, loss, or property damage due to my own actions or negligence during the event.

RCM reserves the right to remove any participant without refund for non-compliance with safety instructions or for unsafe, illegal, or disruptive behavior, to maintain event safety and order.

Indemnity
I agree to indemnify RCM, its affiliates, staff, trustees, contractors, and the property owner from all claims, liabilities, damages, losses, legal costs, or proceedings arising from my actions, negligence, or behavior during the event or from any claim made on my behalf despite this waiver.

Medical Declaration
I confirm that I am in good physical health and aware of no medical condition that would prevent me (or any child/minor I’m responsible for) from participating. I consent to receive medical treatment if required and agree to bear all related costs.

Media & Data Consent
I consent to RCM capturing and using photographs, videos, and recordings of me for promotional or documentation purposes without compensation. All media will remain the property of RCM.

Release of Liability
I waive and release RCM, its affiliates, staff, contractors, and the property owner from all liability for any injury, loss, or damage suffered by me or any child/minor under my care, arising from participation in the event. This release applies to my personal representatives, heirs, and estate.

Severability
If any clause here is deemed unenforceable, it will not affect the validity of the remaining provisions.

Terms & Conditions for Minor Participants

Guardian’s Acknowledgement & Consent

I am the parent or legal guardian of the participant (hereafter referred to as “the minor”) and give my full consent for them to join Reef Check Malaysia’s (RCM) event, Kod Blue: Laut Needs You 2025, at Kampung Juara, Tioman Island on 20 September 2025.

I understand and acknowledge that:

  • I am responsible for arranging the minor’s transport, accommodation, and meals.

  • The minor will be assigned to either a beach cleanup or underwater cleanup activity, depending on the team’s decision on the day.

  • I will inform RCM in advance if the minor is unable to attend.

  • The event participation fee is non-refundable in the case of cancellation.

Waiver of Liability & Assumption of Risk

I understand that participation in the event involves certain inherent risks, which may include:

  • Minor injuries (e.g., cuts, bruises, sprains),

  • Serious injuries (e.g., fractures, head injuries),

  • Risks associated with water-based activities (e.g., swimming, diving),

  • In rare cases, grievous bodily harm or death.

I accept these risks on behalf of the minor and agree that the minor will comply with all instructions, safety notices, and directions provided by RCM staff or volunteers.

I acknowledge that RCM reserves the right to remove any participant, including the minor, from the event without refund for:

  • Non-compliance with safety guidelines or staff instructions,

  • Unsafe, offensive, or illegal behavior,

  • Actions that jeopardise the safety or wellbeing of others.

Indemnity

I agree to indemnify and hold harmless RCM, its staff, volunteers, affiliates, contractors, the property owner and tenants from any and all claims, losses, damages, costs (including legal fees), or liabilities arising out of the minor’s participation, behavior, or negligence during the event.

Medical Declaration & Emergency Consent

I confirm that the minor is in good physical health and has no medical condition that would affect their ability to safely participate. I agree to:

  • Disclose any relevant medical conditions in advance to RCM,

  • Consent to any necessary emergency medical treatment for the minor,

  • Bear full responsibility for all associated medical expenses.

Media & Data Consent

I consent to the minor being photographed or filmed during the event. I grant RCM the right to use these materials for documentation, publicity, or promotional purposes in any media, without expectation of compensation. I understand all materials remain the exclusive property of RCM.

Release

I hereby waive, release and discharge RCM, its affiliates, staff, contractors, and event partners from all liability for personal injury, death, loss, or damage to property involving the minor that arises from participation in the event, except in cases of gross negligence or willful misconduct.

Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining terms shall remain in full force and effect.
